1. Legal guarantee of conformity
The legal guarantee of conformity is governed by articles 128 et seq. of the Consumer Code, in favor of the consumer who purchases products (consumer goods) for personal use (or for purposes unrelated to his professional or business activity), which have conformity defects.
2. Lack of conformity
By conformity defects we mean intrinsic and material defects of a thing, not easily eliminated, which concretely affect its usability, or appreciably decrease its value, or make it unsuitable for the use for which it is intended.
3. When the legal guarantee of conformity does not apply
The legal guarantee of conformity does not cover product defects deriving from normal wear and tear, abnormal or improper use, accidental events (e.g. fall) or in any case maliciously caused to the product itself, nor does it cover defects deriving from repairs carried out by parties other than the manufacturer. or by the seller.
Attention. The warranty does not cover the logo that comes off gloves, as this does not compromise their functionality.
Why does the logo come off? The logo comes off because the glove is coated with a water-repellent film that preserves the leather of the glove.Therefore, the glue with which the logo is attached tends not to adhere perfectly.
4. How Ksport applies the legal guarantee of conformity
In the presence of a lack of conformity, the customer has the right, to the repair or replacement of the defective goods by Ksport, without charge, unless the remedy requested is impossible or excessively expensive compared to the other. If replacement or repair is not possible, the consumer still has the right to a price reduction or to have a sum back, commensurate with the value of the goods, against the return of the defective product to the seller.
5. Duration of the legal guarantee of conformity
The legal guarantee lasts two years from the delivery of the goods and must be asserted by the consumer within two months of discovering the defect: it is therefore necessary to always keep the proof of purchase (electronic purchase receipt or transport document present in the package).
6. How to request the legal guarantee of conformity
To request the legal guarantee of conformity, it is necessary to send an email to firstname.lastname@example.org in which to report the lack of conformity, describe the problem in an exhaustive manner and attach photographic material as evidence of the lack of conformity. After an analysis of the documentation sent, the Ksport customer service will give an initial indication to the customer if the defect depends on a lack of conformity or is attributable to one of the factors described in point 3. In the event that a lack of conformity is found, the customer will be authorized to ship the defective product to Ksport to check in depth whether the malfunction depends on a lack of conformity or not. Shipping costs are charged to the customer. It is not possible to request the paid collection service, intended only for returns. If the lack of conformity is found, Ksport will repair or replace the goods within a reasonable time from the request and without charging the consumer. Product replacements may have limitations based on the manufacturer's supplies, in this case Ksport will refund the sum or supply a product of similar value. For any dispute, the territorial jurisdiction is exclusively that of the Court of Padua.
