1. Legal guarantee of conformity

The legal guarantee of conformity is governed by articles 128 and ss. of the consumer code, in favor of the consumer who acquires products (consumer goods) for personal use (i.e. for purposes unrelated to his professional or entrepreneurial activity), which present defects of conformity.

2. Defects of conformity

By compliance defects we mean intrinsic and material vices of one thing, not easily eliminated, which concretely affect its usability, or decrease its value in a appreciable way, or making it unsuitable for the use it is intended.

3. When the legal guarantee of conformity does not apply

The legal guarantee of conformity does not cover the defects of the product deriving from normal wear, anomalous or improper use, from accidental events (e.g. fall) or in any case maliciously caused to the product itself, nor does it cover the defects deriving from repairs made by subjects other than the manufacturer or from the seller.

4. How Ksport applies the legal guarantee of conformity

In the presence of a defect in conformity, the customer has the right, to the repair or replacement of the defective asset (this is assessed by Ksport based on the nature of the defect) by Ksport, without charge of expenses, unless the remedy required is impossible or excessively onerous compared to the other. If replacement or repair are not possible, the consumer is however entitled to reducing the price or to have a sum back, commensurate with the value of the property, in the face of the return to the seller of the defective product.

5. Duration of the legal guarantee of conformity

The legal guarantee lasts two years from the delivery of the asset and must be asserted by the consumer within two months of the discovery of the defect: it is therefore always necessary to keep the purchase test (purchase electronic receipt or transport document present in the package).

6. How to request the legal guarantee of conformity

To request the legal guarantee of conformity, you need to send an email to info@combatarena.it in which to report the habit of conformity, comprehensively describe the problem and attach photographic material to testify to the defect of conformity.

After an analysis of the documentation sent, the KSPORT Customer Service will give the customer a first indication if the defect depends on a defect of conformity or is attributable to one of the factors described in point 3.

If a defect of conformity is recognized, the customer will be authorized to send the defective product to Ksport to check in depth whether or not the malfunction depends on a defect in conformity. The product subject to guarantee must be received at Ksport Srl within 30 days of the guarantee approval. Shipping costs are charged to the customer. It is not possible to request the withdrawal service.

If the vice of conformity is found, Ksport will carry out the repair or replacement of the property within a reasonable time (which may vary from 10 to 30 days for national production items, and 30 to 60 days for international production items) from the request and without debit of consumer expenses. The return costs to the customer of the repaired/replaced product are borne by Ksport.

Product substitutions may have limitations based on the supplies of the manufacturer, in this case Ksport will return the sum or the supply of a product of similar value.

7. sale of the guarantee

The buyer can give in the right of guarantee to third parties in the event of the sale of the asset. In this case it will always have to be the customer who has ordered the guarantee.

For each controversy, the territorial competence is exclusively that of the Padua forum.
