1. Legal warranty of conformity

The legal warranty of conformity is governed by Articles 128 et seq. of the Italian Consumer Code and applies to consumers who purchase products (consumer goods) for personal use (i.e. for purposes unrelated to their professional or business activity) that show defects of conformity.

2. Defects of conformity

Defects of conformity are intrinsic and material defects of a product, not easily removable, which concretely affect its usability, significantly reduce its value, or make it unsuitable for the use for which it is intended.

3. When the legal warranty of conformity does not apply

The legal warranty of conformity does not cover product defects resulting from normal wear and tear, abnormal or improper use, accidental events (e.g. falls), or defects intentionally caused to the product. It also does not cover defects resulting from repairs carried out by parties other than the manufacturer or the seller.

4. How Ksport applies the legal warranty of conformity

In the presence of a defect of conformity, the customer is entitled to repair or replacement of the defective product (as assessed by Ksport based on the nature of the defect), at no cost, unless the requested remedy is impossible or excessively burdensome compared to the alternative. If repair or replacement is not possible, the consumer is entitled to a price reduction or a refund proportionate to the value of the product, upon return of the defective item to the seller.

5. Duration of the legal warranty of conformity

The legal warranty lasts two years from delivery of the product and must be claimed by the consumer within two months of discovering the defect. It is therefore necessary to always keep proof of purchase (electronic purchase receipt or delivery document included in the package).

6. How to request the legal warranty of conformity

To request the legal warranty of conformity, it is necessary to send an email to info@combatarena.it, reporting the defect of conformity, clearly describing the issue, and attaching photographic material as evidence of the defect.

After reviewing the documentation provided, Ksport customer service will give the customer an initial indication as to whether the defect is due to a conformity issue or attributable to one of the factors described in point 3.

If a defect of conformity is identified, the customer will be authorized to ship the defective product to Ksport for further verification. The product under warranty must be received by Ksport Srl within 30 days from warranty approval. Free shipping labels will be provided. Collection service cannot be requested.

If the defect of conformity is confirmed, Ksport will repair or replace the product within a reasonable timeframe (which may vary from 10 to 30 days for domestically produced items, and from 30 to 60 days for internationally produced items) from the request, at no cost to the consumer. The cost of returning the repaired/replaced product to the customer will be borne by Ksport.

Product replacements may be subject to limitations based on the manufacturer's supply; in such cases, Ksport will provide a refund or supply a product of equivalent value.

7. Transfer of the warranty

The purchaser may transfer the warranty rights to third parties in the event of transfer of ownership of the product. In this case, the warranty request must always be made by the customer who placed the original order.

Any dispute shall fall under the exclusive jurisdiction of the Court of Padua.
